Important changes in holiday rentals in Spain region Murcia from April 2025
Do you have a holiday home in Spain that you rent out? Then there is important news! From 3 April 2025, the rules regarding tourist rentals will change. Especially if your home is in an apartment complex with a Comunidad de Propietarios (VvE), you should pay attention.
What does the new law entail?
Until now, you could rent out your home by simply applying for a tourist permit from the municipality. But from April 2025, you will also need permission from the Comunidad de Propietarios (VvE). At least 60% of the owners within the complex must agree to the rental. No approval? Then you can no longer offer the home as a holiday home.
What if you already have a permit?
Good question! Do you already have a valid tourist rental permit before April 3, 2025? Then you can continue to use it. But be careful: if you sell the house, the permit will automatically expire. The new owner must then request permission from the Comunidad de Propietarios (VvE) again and apply for a new permit.
What can Community of Owners (VvE)s decide?
From April, Comunidad de Propietarios (VvE)s can be stricter in their policies on holiday rentals. They can:
- Completely ban renting (provided that 60% of the owners agree).
- Imposing additional costs on landlords, up to a maximum of 20% on top of the regular common costs.
What does this mean for you as an owner?
Do you want to continue renting? Then it is smart to follow these steps:
- Check the rules of your Comunidad de Propietarios (VvE) : Ask whether tourist rentals are allowed and whether there are any additional costs involved.
- Check your permit : Do you already have a permit? Then it remains valid, unless you sell the house.
- Stay in touch with the Comunidad de Propietarios (VvE) : Keep your fellow residents informed of your plans and respect joint agreements.
Why these new rules?
With these rules, the Spanish government wants to better balance the balance between holiday rentals and permanent residents. It also hopes to better regulate the impact of tourism on residential areas. For landlords, this means extra steps, but ultimately it will ensure a fairer and better organized market.
